Suspect Charged in Fatal Burville Road Accident

Massey’s death underscores state delay in launching mental health response program

CRETE – Illinois State Police (ISP) Troop 3 and Division of Criminal Investigation Zone 1 officers arrested 58-year-old l William D Fanning of Rancho Cucamonga, CA, for two counts of Aggravated Driving Under the Influence of Drugs Involving Death (Class 2 Felony).

On April 16, 2025, ISP officers investigated a two-vehicle fatal traffic crash at the intersection of Illinois 394 and Burville Road in Crete, IL.
A truck tractor semi-trailer was traveling eastbound on Burville Road, and a Chevrolet Malibu was traveling southbound on Illinois 394. The semi failed to yield while turning left, causing the front end of the Chevrolet to strike the semi’s trailer. ​
The Chevrolet proceeded under the trailer of the semi. The driver of the Chevrolet, 40-year-old Joshua D. Kutz of Chicago, IL was transported to an area hospital and pronounced deceased. ​ ​ ISP troopers placed Fanning under arrest. ​ Fanning reportedly consumed methamphetamine before the fatal crash.
On April 18, 2025, ISP special agents presented their case to the Will County State’s Attorney’s Office, and the above-mentioned charges were filed against Fanning. Fanning is being held pending his first court appearance.
